Terms of Service

Article 1 (Purpose)

These Terms govern the rights, obligations, and responsibilities between Ascendy ("Service") and users regarding the use of the Service.

Article 2 (Definitions)

  1. "Service" refers to the cloud-based platform that enables users to store, manage, search, and share photos and videos.
  2. "User" refers to any person who uses the Service in accordance with these Terms.
  3. "Content" refers to photos, videos, text, and other materials uploaded by users to the Service.

Article 3 (Effect and Amendment of Terms)

  1. These Terms become effective when posted on the Service screen or otherwise notified to users.
  2. The Service may amend these Terms within the bounds of applicable laws and will provide 7 days' notice before changes take effect.

Article 4 (Service Agreement)

  1. The service agreement is established when the user agrees to these Terms and completes registration.
  2. Users under the age of 14 may not use the Service.

Article 5 (Service Features)

The Service provides the following features:

  • Cloud storage for photos and videos (including optional device gallery auto-sync)
  • AI-based auto-classification and search
  • Face recognition for organizing by person
  • Photo sharing with friends (Pod)
  • Photo management via AI agent (including optional location-based and voice queries)
  • AI image editing (Studio)

Article 6 (User Obligations)

Users shall not:

  1. Misappropriate others' personal information or accounts
  2. Store or distribute illegal content through the Service
  3. Interfere with normal operation of the Service
  4. Infringe on others' copyrights or intellectual property rights
  5. Violate other applicable laws

Article 7 (Content Ownership)

  1. Ownership of content uploaded by users belongs to the users.
  2. The Service will not use user content for purposes other than service provision.
  3. For AI analysis, conversation, and image editing, user content may be transmitted to and processed by external AI providers as described in the Privacy Policy; it is not sold to third parties or used for advertising purposes.
  4. Content shared to a Pod is visible to all Pod members, and each member can control whether their shared content is included in AI processing via Pod settings.
  5. Results generated by AI features (such as Studio edits) are provided for the user's personal use; the Service does not guarantee their accuracy or fitness for a particular purpose.

Article 8 (Service Restrictions)

The Service may restrict user access in the following cases:

  1. Violation of these Terms
  2. Uploading illegal content
  3. Intentionally interfering with Service operations

Article 9 (Service Interruption)

  1. The Service may be temporarily suspended for system maintenance or equipment replacement.
  2. Prior notice will be given for service interruptions; in unavoidable circumstances, notice may be given afterward.

Article 10 (Storage Capacity)

  1. The Service provides users with basic storage capacity free of charge.
  2. Additional storage capacity may be provided for a fee.
  3. Certain features (such as Studio AI image editing) consume points provided according to the user's plan.

Article 11 (Limitation of Liability)

  1. The Service is not liable for service interruptions due to natural disasters or force majeure.
  2. The Service is not liable for damages caused by user negligence.
  3. The Service does not guarantee any profits or benefits users expect from the Service.

Article 12 (Account Withdrawal)

  1. Users may withdraw at any time through the Service settings.
  2. User content will be deleted within 30 days of withdrawal.

Article 13 (Dispute Resolution)

Disputes related to these Terms shall be governed by the laws of the Republic of Korea, with jurisdiction in the court of the Service provider's location.
